The exercise of human rights requires government plans and public policies that articulate state actions to guarantee, protect, respect and promote them. At the world conference on human rights in Vienna in 1993, was emphasized the obligation of states - which are part of international human rights treaties - to take measures in all public spheres, including legislative and judicial, to comply with its human rights obligations

 

Different organizations articulated to the United Nations, such as the Rapporteurs for Education and Health and the Office of the United Nations High Commissioner for Human Rights, proposed methodological routes to incorporate the human rights approach into national and subnational public policies. The international impulse was finding an echo in the regional human rights systems, such as the Inter-American Human Rights System, who have contextualized the guidelines and particular contributions to the Latin American region.


The articulation between the human rights approach and public policy is far from automatic aplication, and represents multiple political and technical challenges, relevant both in nationally and subnationally levels. Human rights organizations, academic institutions, civil society organizations and government agents in Latin America, and in other regions of the world, have made specific proposals to formulate, implement and evaluate public policies from a human rights approach.

 

Under this framework, the workshop aims to talk about methodological experiences that have faced the challenges linked to the articulation of the human rights approach in concrete experiences of public policies. The questions for discussion are as follows

-What successful examples are of articulation of public policy and human rights?
-What examples of failure are of articulation of public policy and human rights?
-What are the challenges of articulating the human rights approach to public policies in specific cases?
-In what contexts is it intended to articulate public policy with a human rights approach?
-What have been the most relevant results of designing public policies with a human rights approach?
-If there has been no result, what is the reason?


The panel has the expectation of opening discuss the methodologies used in specific cases to face the challenges, political and technical, and to identify more clearly experiences in different regions.

CALL FOR PAPERS

 

The panel has the expectation of discussing conceptual and methodological elements around specific experiences of specialists, institutions or organizations that have faced the challenges of articulating public policies with the human rights approach. Therefore, it is relevant that the proposals of papers incorporate conceptual elements to argue about the methodological outputs raised in each case.
 
 
The panel invites specialists, including students who are conducting research on the subject, government institutions and civil society organizations. The type of experiences that are of interest include, but are not limited to, the following:
- Use of human rights standards in public policy
- Formulation, monitoring and evaluation of plans and programs with a human rights approach
- Transversalization of human rights in national and subnational planning
- Proposals for or of subnational governments to fulfill their human rights obligations.
- Use of public policy analysis with a human rights approach for justiciability and / or advocacy.

ABSTRACT

BIOGRAPHICAL PRESENTATION

 

Luis Daniel Vázquez Valencia is a part-time research professor at Flacso México since October 2007 and a full-time research professor at the Institute of Legal Research (IIJ)- UNAM. He has studies in law, political sociology and political science. His research topics include the Legal Theory of International Human Rights Law, the relationship between democracy and human rights, the construction of identities from a political discourse based on human rights, and the costs of impunity in the exercise of human rights.

 

He has participated in multiple research projects on institutionalization and the exercise of human rights; the measurement of human rights; public policies and regulatory systems related to human rights; and on constitutional reform in the field of human rights.

 

Claudia Ileana Espinosa Díaz is a professor in the Master's Degree in Human Rights and Democracy at Flacso México and an independent consultant in public policy and human rights. She has studies in sociology, human rights and democracy, training in anthropology, public policies and education. Claudia has accompanied processes of evaluation and design of public policies with different governmental entities and social organizations, and promoted training and professionalization schemes for public officials at the subnational level in Mexico
 
Together, Daniel and Claudia have published results of research on human rights intermediations between Political Constitutions and Public Policies. Since 2014, they coordinate the thesis seminar "Public Policies and Human Rights" in the Master of Human Rights and Democracy in Flacso Mexico.
